Official Contest Rules

1. NO PURCHASE NECESSARY TO ENTER OR TO WIN. CONTEST IS OPEN TO LEGAL RESIDENTS OF THE 50 UNITED STATES OR THE DISTRICT OF COLUMBIA. QUOTE AUTHORS MUST BE 17 YEARS OF AGE OR YOUNGER AT TIME OF ENTRY, AND THEREFORE MUST SUBMIT THEIR ENTRY BY CONSENT OF OR IN CONJUNCTION WITH A PARENT OR LEGAL GUARDIAN. VOID WHERE PROHIBITED.



2. Sponsor/Administrator: The Earthbound Farm Kids’ Quote Contest (“Contest”) is sponsored and administered by Natural Selection Foods (dba Earthbound Farm), 1721 San Juan Highway, San Juan Bautista, CA 95045 (“Sponsor”).



3. How to Enter: Simply visit http://www.ebfarm.com/Products/KidsQuoteContest.aspx and follow the online prompts to submit your Entry. An individual (“Entrant”) can enter the Contest from Wednesday, July 1, 2009 until June 30, 2010, or until the entry form is closed and removed from Sponsor’s Website. Sponsor reserves the right in its sole discretion to suspend, modify, or terminate the Contest at any time. 
1. All Entries must be submitted via the Sponsor’s Website. At least one parent or legal guardian must provide their name, e-mail address, and daytime phone number with any Entry for it to be accepted. Entries not containing this information will be disqualified automatically.
2. All information collected on the Website is subject to Earthbound Farm’s privacy policy (http://www.ebfarm.com/privacy.aspx).
3. All Entries become the sole property of Sponsor and will not be acknowledged or returned. Sponsor is not responsible for incomplete or corrupted Entries. 
4. Entrants may submit more than one Entry to the Contest, but each Entry must be unique. Multiple submissions of the same materials are not permitted and may be grounds for disqualification.
5. Any Entrant encountering trouble in submitting all or part of their Entry should e-mail Webmaster@ebfarm.com for help; Sponsor is not responsible for Internet service interruptions or the outcome of any technical support.
6. All decisions of the Sponsor regarding qualification and judging of Entries, selection of winners, and all other aspects of the Contest shall be final and binding in all respects.


4. Eligibility: The Contest is open only to individuals who are legal residents of the fifty (50) United States or the District of Columbia and who are 17 years of age or younger at the time of entry.
1. All Entries must be made by consent of or in conjunction with the Entrant’s parent or legal guardian. All Entries must include the name, e-mail address, and daytime phone number of at least one parent or legal guardian who has given their consent for entry into the Contest. Entries not containing this information will be disqualified automatically.
2. The Contest is not open to any children of employees of Natural Selection Foods (dba Earthbound Farm), its affiliates, subsidiaries, advertising or promotional agencies, or the immediate family members of, and any persons domiciled with, such employees.


5. Eligible Entries: All Entries must be the Entrant’s original creation and must be submitted in English. By submitting an Entry or accepting any prize, Entrant and their parent/legal guardian represent and warrant that it is Entrant’s original creation, that it has not been copied in whole or in part from any other work, that it does not violate or infringe any copyright, trademark, or other proprietary right of any other person or entity, and that is their sole property. Entrant and their parent/legal guardian represent and warrant that they have full legal right, title, and capacity to submit the Entry to Sponsor, and that Sponsor has full and unfettered right to use, copy, adapt, and publish same in any and all media for any purpose whatsoever. Entrant and their parent/legal guardian agree to indemnify and hold harmless Sponsor and its agencies for any action brought by a person whose material was used in any Entry without consent.



6. Disqualification: Entries not containing the name, e-mail address, and daytime phone number of at least one parent/legal guardian indicating permission and consent will be automatically disqualified. Any Entry featuring any content determined by Sponsor, at its sole discretion, to be illegal, indecent, inappropriate, objectionable, or otherwise unfit for publication will be disqualified. Multiple submissions of the same materials are not permitted. Entries not satisfying these Official Rules in any respect will be disqualified.



7. Winner Selection: Approximately monthly from the start of the Contest and for as long as Contest is open, Sponsor will review all eligible Entries and select one or more winners, at Sponsor’s discretion.
1. Entries will be judged equally on the basis of originality (50%) and how appropriately they complete the contest theme, “Thank you for choosing organic — it matters to me because…” (50%).
2. Sponsor’s decisions will be final and binding in all matters relating to this contest.


8. Prizes:
1. Each winning quote will be reproduced on the back of an Earthbound Farm salad container label and posted on Sponsor’s Website. The author will be identified by first name, age, city, and state.
2. Prize winners (collectively, “Winners”) will receive the following:
1. A donation in the amount of $500 made in their name to their choice of one of the following nonprofit environmental organizations: American Forests, Beyond Pesticides, Environmental Working Group, Healthy Child Healthy World, Natural Resources Defense Council, Organic Farming Research Foundation, Pesticide Action Network North America, or Union of Concerned Scientists.  
2. A $500 US Savings Bond.


9. Winner Notification: Winners will be notified by e-mail and/or telephone, and a list of Winners will be posted on Website beginning on or about July 20, 2009. 
1. At least one parent or legal guardian must provide their name, e-mail address, and daytime phone number with any Entry to indicate permission and consent. The parent/legal guardian or minor child must provide their Social Security Number to receive the prize and register the US Savings Bond. Winners are solely responsible for reporting and payment of all federal, state, and local taxes on their prize.
2. Winners’ parent/legal guardian will be required to execute and return within ten (10) days of notification an affidavit of eligibility and a liability and publicity release (“Release”) on behalf of the minor Winner, except where prohibited by law. Failure to sign and return the Release within ten (10) days, or to comply with any term or condition of these Official Rules or the prize notification message, will result in a Winner’s disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to an alternate Winner.
3. Winners may waive their right to receive a prize.  
4. The return of a prize notification as undeliverable, or Sponsor’s inability to contact a Winner’s parent/legal guardian by phone, may result in disqualification, and an alternate winner may be selected. Sponsor is not responsible for notifications that are misdirected because of e-mail addresses or phone numbers that are no longer in service, e-mail or voice message accounts that are not receiving mail, Internet or telephone service interruptions, or for any reason beyond Sponsor’s control.
5. Any personally identifiable information received from Entrants and Winners, other than that which will be used to identify winning quotes on Sponsor’s website and on Sponsor’s packaging, will be used only to verify eligibility and award prizes. 6. Any federal, state, or local taxes, and any other expenses or costs associated with prize acceptance and use not specified as being awarded herein are the sole responsibility of the Winners. No substitution, cash alternative, or transfer of any prize permitted, except Sponsor may, at its discretion, substitute a prize (or portion thereof) of comparable or greater value. Prizes are awarded “as is” with no warranty or guarantee, either express or implied. All prize details are at the sole discretion of Sponsor.


10. Waiver: All Entrants, by participation in this Contest and/or acceptance of a prize, agree to release Sponsor and its divisions, affiliates, subsidiaries, distributors, suppliers, and agencies and their respective employees, officers, directors, agents, and legal advisors from any and all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to persons and property which may be sustained in connection with their participation in the Contest or acceptance, receipt, ownership, or use/misuse of a prize, including, without limitation, personal injuries and claims based on publicity rights, defamation, or invasion of privacy. Every Entrant agrees that Sponsor and its divisions, affiliates, subsidiaries, distributors, suppliers, and agencies, and their respective employees, officers, directors, agents, and legal advisors shall not be liable or responsible for any errors in software, typography, administration, announcement of prizes, or other inadvertent errors in these Official Rules or in other materials relating to the Contest.



11. General Terms: All decisions of the Sponsor regarding qualification and judging of Entries, selection of winners, and all other aspects of the Contest shall be final and binding in all respects.
1. Incomplete or corrupted entries shall be void. Any questions regarding the number of entries submitted shall be determined by Sponsor in its sole discretion; multiple submissions of the same materials are not permitted and may be grounds for disqualification. All entries become the property of the Sponsor and will not be returned. Entries that have been tampered with or altered are void. The Sponsor, in its sole discretion, reserves the right to disqualify any person tampering with any Entry, any aspect of the Contest, the operation of the Website, or who is otherwise in violation of the Official Rules. 
2. By entering, Entrants acknowledge compliance with these Official Rules, including all eligibility requirements. In the event of any dispute concerning the identity of any Entrant, the Entry will be deemed submitted by the natural person who is the authorized holder of the transmitting e-mail account on behalf of a minor who is their natural child or legal ward.  
3. Sponsor is not responsible for injury or damage to Entrant’s or to any other person’s computer related to or resulting from participating in the Contest.  Sponsor reserves the right in its sole discretion to suspend, modify, or terminate the Contest at any time. Sponsor is not responsible if the Contest cannot be implemented or prizes cannot be awarded due to delays or interruptions due to acts of God, acts of war, strikes, governmental action, natural disasters, weather, or acts of terrorism. 
4. All federal, state, local and municipal laws and regulations apply.


12. Disputes: Each Entrant agrees to release, defend, indemnify, and hold harmless Sponsor, those working on its behalf, and each of their respective officers, directors, representatives, employees, agents, successors and assigns, from any damage, injury, death, loss or other liability, either at law or equity, whether known or unknown, asserted or non-asserted, that may arise from or in any way relate to any Entrant’s participation in this Contest. Any and all disputes, claims, and causes of action arising out of or in connection with this Contest shall be resolved individually, without resort to any form of class action. This Contest shall be governed by, and construed in accordance with, the laws of California and of the United States. Any action or litigation concerning this Agreement shall take place exclusively in the federal or state courts in California, and each Entrant expressly consents to the jurisdiction of and venue in such courts and waives all defenses of lack of jurisdiction and inconvenient forum with respect to such courts. Any claims, judgments and/or awards shall be limited to actual out-of-pocket costs associated with entering this Contest. Entrant hereby waives any rights or claims to attorney’s fees, indirect, special, punitive, incidental or consequential damages, whether foreseeable or not and whether based on negligence or otherwise.
